1.1 - These Terms and Conditions regulate the sale, including registration, of BALSAN products, through the website www.balsanofficial.com, protected by copyright.

 

1.2 - The website www.balsanofficial.com is managed by the company FI&CO, nº515674699, Rua da Escola, Braga.

 

 1.3 - For the purposes of these Terms and Conditions, is meant by:

      a) - "BALSAN" - Products sold on the website www.balsanofficial.com;

      b) - "User" - Any natural person, over 18 years of age and/or older in the jurisdiction of their residence, with the legal possibility to contract and use their own means of payment, non-trader, who places an order through the website www.balsanofficial.com;

 

1.4 - The use of the website, www.balsanofficial.com, and the purchase of BALSAN products presupposes the knowledge, understanding, and acceptance of these Terms and Conditions by the User, the reproduction, transmission, and redistribution to third parties, for commercial purposes are strictly prohibited without the prior BALSAN's consent.

 

2. REGISTRATION ON THE WEBSITE

 

2.1 - To place an order, the User may previously register, by filling in the fields on the form on the website www.balsanofficial.com. It is also possible to place your order without prior registration.

 

2.2 - From the moment the User accesses his personal account, the User is subject to these Terms and Conditions.

 

2.3 - The fraudulent use of the website is not allowed, contrary to the law or good customs

 

2.4 - The user thus accepts that it will be the Portuguese legislation to regulate any conflict with the consumer, agreeing that any legal issue, related to the use of the website www.balsanofficial.com, is addressed exclusively at the Court of Braga, in Portugal, without prejudice to the provision imperative to the contrary in Portuguese law, Community directive or international treaty.

3. BALSAN PRODUCTS

 

3.1 - The website www.balsanofficial.com is aimed at all users who wish to purchase BALSAN products, 24 hours a day, 7 days a week.

 

3.2 - Information on the characteristics of the products can be consulted at www.balsanofficial.com.

 

3.3 - BALSAN reserves the right to modify, at any time, the information, product offer, prices, promotions, and commercial conditions, presented on the website.

 

4. ORDERING ON THE WEBSITE

 

4.1 - To order on www.balsanofficial.com it is necessary that the User has an e-mail account and that his browser is configured to accept cookies and pop-ups, which will allow him to enjoy all the browsing conditions of the store online BALSAN.

 

4.1.1 - The User may proceed with the online purchase of products, for which it is necessary that:

      a) Find the product(s) to purchase;

      b) Add the selected product(s) to the "Shopping Cart";

      c) Register the User's personal data, which will be integrated in the BALSAN database under the terms provided for in the Privacy Policy, which include "Delivery Address", "Billing Address", "Payment Method", telephone number and tax identification number (TIN);

       d) Review your order and confirm the order;

 

 4.2 - The User will receive an order confirmation email with details regarding the payment method he has selected.

 

 4.3 – The order will be delivered by the logistics operator to the delivery address indicated in the purchase process.

 

 4.4 - By sending the order form the User accepts the Purchase Terms and Conditions described at www.balsanofficial.com, as well as with the Privacy Policy.

 4.5 - BALSAN reserves the right not to accept and cancel orders already confirmed in the following situations:

      a) The product is not available;

      b) Payment is not made using any of the payment options available on the website www.balsanofficial.com;

      c) the payment is not confirmed;

      d) The billing information is not correct or verifiable;

      e) There is an error in the price quote;

      f) It is not possible to deliver to the address provided by the User.

 

5. PRICES

 

5.1 - The prices of the products displayed on the website www.balsanofficial.com include Value Added (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the user.

 

5.2 - Prices are all quoted in euros (€). Please note that changing the country of delivery may influence prices due to different shipping costs. Customs costs related to the country of delivery of the order will be borne by the customer.

 

5.3 - The prices of products presented on the website are subject to change. BALSAN reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase

 

5.4 - If there is an error in the price of the requested products, BALSAN or the User may, until the order is dispatched, cancel the order.

 

5.5 - The total price specified in the checkout includes taxes from the country of origin (Portugal).

 

5.6 - The User must pay only the amount specified in the order confirmation (plus shipping costs). Customs duties and taxes for non-EU countries, as well as additional charges, will be charged directly by the customs of the country of destination, please contact your local customs services for more information.

 

5.7. Accepted payment methods are: bank transfer or cash.

6. PAYMENT METHODS

 

6.1 - BALSAN does not accept any payment method other than those mentioned in the previous point. The User must not attempt to pay by any means other than those specified in the payment methods specified. If you do, we cannot be held responsible for the loss of payment or any other damages that may result.

 

7. SHIPPING COSTS

 

7.1 - All orders will have an associated shipping cost, which may require payment of customs costs, according to the country of delivery.

 

8. DELIVERY

 

8.1 - BALSAN proceeds to send the product (s) ordered by the User, from Monday to Friday, from 9 am to 7 pm, with the exception of holidays, and on the days and times used by the logistics company, to the delivery address specified by the User.

 

8.2 - Our delivery service does not include scheduling options, the day before delivery the buyer will receive a message indicating the day on which their order will be delivered, as well as the code to follow, and it is necessary to ensure that someone is at the delivery address.

 

8.3 - Delivery times in Portugal vary between 20 working days according to the item ordered. BALSAN's ability to respond within these deadlines, depending on stock availability, as well as during promotions, sales, and Christmas periods.

 

8.4 - BALSAN will inform the User of the unavailability of the product (s) ordered (s), as well as proceed with the refund of the amount paid.

 

8.5 - At the time of delivery, the User must inspect the packaging in order to check for possible damage. If the user finds that the products are damaged, the User should not accept the delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via the email balsanofficial@gmail.com and if he agrees, BALSAN will resend the order, without any costs to the User. If the User wishes to cancel the order, the full amount paid will be returned.

 

8.6 - If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of the order, please send an email to balsanofficial@gmail.com. After this period, BALSAN will not be responsible for the loss of the order.

 

8.7 - Delivery is considered to have been made with the signature on the delivery receipt at the agreed address.

 

9. RIGHT OF FREE RESOLUTION

 

9.1 - The User may terminate his contract up to 14 (fourteen) days after receiving the order, provided that:

      a) The product (s) have not been used;

      b) The product (s) keep their original characteristics and labels intact;

      c) The product (s) are complete. All material accompanying orders must be returned.

 

9.2 - Exchanges and returns are not made for personalized products. Personalized products are those items that are adjusted, made with specific measures, and products that have been altered in their manufacture at the buyer's request.

 

9.3 - The User can exercise his right of free resolution by sending the Free Resolution model or any other unambiguous declaration of termination of the contract, to the email balsanofficial@gmail.com.

 

9.4 - The costs of returning the order in the exercise of the right of free resolution are borne by the customer.

 

9.5 - Once the returned product has been received, BALSAN will analyze and confirm the conservation status of the order and, when applicable, will refund within 14 (fourteen) work days the amounts paid by the User included in the order, using the same means used to payment of the order.

 

9.6 - If the returned items show signs of use, BALSAN reserves the right not to accept the return and to refuse to refund them.

9.7 - The User should note that, if their return was made for reasons other than the justified existence of defect or non-conformity of the products ordered, BALSAN will not refund the shipping costs. Therefore, BALSAN will not reimburse expenses related to the shipping costs initially borne by the customer for the respective order.

 

10. CANCELLATIONS AND RETURNS

 

10.1 - The User can cancel his order, as long as he requests it through the email balsanofficial@gmail.com before its shipping.

 

10.2 - If the order was received before shipping, we will refund the amounts paid by the User included in the order, using the same method used for payment of the order, within a maximum period of 14 (fourteen) days.

 

10.3 - If the request was received after shipping, the rules contained in the previous chapter, regarding the right of free resolution, will apply.

 

10.4 - BALSAN does not offer direct exchanges. The User will be able to choose a voucher to exchange his order for another item available on the website, being responsible for all costs related to the new shipment. Please note that orders placed with a voucher and later returned will only be able to receive a new voucher as a refund.

 

10.5 - In the event that the ordered product is found to be defective, the User may choose to:

      a) replace the product;

      b) terminate the contract.

 

10.6 - As soon as the User finds a defect or other non-conformity of the product, he must communicate to us through the email balsanofficial@gmail.com, sending supporting photographs.

 

10.7 - As soon as we receive the User email, we will contact you to resolve the problem by consensus.

 

10.8 - In any of the options exercised by the User, under the terms of 10.6, the respective costs will always be borne by BALSAN.

 

11. QUALITY

 

BALSAN does not sell second-hand products, defective or of inferior quality to the standards of those on the market. The main characteristics of each product shown on www.balsanofficial.com can be found on each product page.

BALSAN will make every effort to ensure that the colors of the products appearing on the website www.balsanofficial.pt are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is showing the exact colors.

 

12. COMPLAINTS

 

In view of the objective of continuous improvement of the services provided, BALSAN will seek to address and resolve complaints submitted by the User within 5 (five) business days, via email balsanofficial@gmail.com

 

13. WARRANTY AND AFTER-SALE SERVICES

 

BALSAN products benefit from the compliance guarantee provided by the legislation applicable to the sale of consumer goods.

 

14. EXCLUSION AND LIMITATION OF LIABILITY

 

BALSAN does not guarantee the uninterrupted functioning of the website, or any of its functionalities, and it may be suspended for maintenance, repair, or updates.

BALSAN will also not assume any responsibility for any damages, arising, directly or indirectly, from situations of force majeure that prevent BALSAN, in any way, from fulfilling its obligations, namely, strikes, network failures electricity, telecommunications services or any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays from suppliers or carriers and changes in legislation or administrative regulations.

BALSAN is not responsible for any abuse of the User's access data to the website by third parties, as they are personal and non-transferable.

 

15. MODIFICATION OF TERMS AND CONDITIONS

 

BALSAN reserves the right to change these Terms and Conditions at any time, considering the changes made and the users notified by publishing the modified Terms and Conditions on the website www.balsanoffficial.com.

 

16. TREATMENT OF PERSONAL DATA

 

We ask that you read our Privacy Policy carefully so that you can become aware of the rules and procedures adopted by BALSAN with regard to the treatment of the data collected when you browse the website www.balsanofficial.pt and when you use the features offered by it, as well as the applicable security and confidentiality measures.

 

17. PROOF AND ARCHIVE

 

The computer records, kept by BALSAN in safe conditions, are considered as proof of the communications, orders, and payments made between BALSAN and the User.

 

18. APPLICABLE LAW

 

These Terms and Conditions and all emerging disputes that are related to them, including their validity, use of the website, or any purchase on it must be governed by Portuguese law.
